The Decission Announcement of Bid Rigging Case in Construction of School and Health Care Buildings in Nias District
The Commission has finished carrying out of inspections and made a decision on Case No.30/KPPU-L/2009 i.e. Alleged Violation of Article 22 of Law No.5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition.Dugaan Pelanggaran tersebut terkait dengan Tender Bangunan Sekolah dan Kesehatan Kabupaten Nias Satuan Kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Tahun Anggaran 2009. Such alleged violations were related to the Tender for Construction of School and Health Care Buildings in Nias District for the Working Unit of Nias Rehabilitation and Reconstruction Agency for Fiscal Year 2009.Majelis Komisi dalam perkara ini terdiri dari Ir. The Commission Assembly that handled this case comprised Ir.Nawir Messi, M.Sc sebagai Ketua Majelis, Ir. Nawir Messi, M.Sc as Chairman of the Commission; Ir. H. H. Tadjuddin Noer Said, dan Dr. Yoyo Arifardhani, SH, MM LL.M masing-masing sebagai anggota. Tadjuddin Noer Said and Dr. Yoyo Arifardhani, SH, LL.M MM respectively as members of the Commission.
Based on some investigation results, the business actors alleged of violations and made as the Reported Parties are as follows:
- PT. PT Taramulia Setia Pratama Luhur, (Terlapor I);Taramulia Setia Pratama Luhur, (the Reported Party I);
- PT.PT. Untario Metalindo, (Terlapor II); Untario Metalindo, (the Reported Party II);
- PT Eka Perkasa Indah, (Terlapor III);PT. Eka Perkasa Indah, (the Reported Party III);
- The Tender Panitia Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara, (Terlapor IV);Committee for Construction of Buildings, Schools, and Health Care for Working Unit of Nias Rehabilitation and Reconstruction of North Sumatra Province (the Reported Party IV);
- The Project Manager of the Tender Panitia Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara, (Terlapor IV);for Construction of Buildings, Schools, and Health Care for Working Unit of Nias Rehabilitation and Reconstruction of North Sumatra ProvincePejabat Pembuat Komitmen Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara (Terlapor V); (the Reported Party V); and
- Kepala Satuan Kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara (Terlapor VI).Head of the Working Unit of Rehabilitation and Reconstruction of Nias Islands of North Sumatra Province (the Reported Party VI).
In its decision, the Commission Assembly has decided that:
- The Reported Parties expressly proved to be involved in tender conspiracies were PT Taramulia Setia Pratama Luhur (the Reported Party I), PT.Untario Metalindo (Terlapor II), PT Eka Perkasa Indah (Terlapor III) dan Panitia Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara (Terlapor IV) dengan denda dan sanksi yang berbeda sesuai dengan peran dan keterlibatan masing-masing pihak dalam persekongkolan lelang tersebut; Untario Metalindo (the Reported Party II), PT Eka Perkasa Indah (the Reported Party III) and the Tender Panitia Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara, (Terlapor IV);Committee for Construction of Buildings, Schools, and Health Care for Working Unit of Nias Rehabilitation and Reconstruction of North Sumatra Province (the Reported Party IV) with different penalties and sanctions in accordance with each party’s respective roles and involvement in any tender conspiracies;
- The Project Manager of the Tender Panitia Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara, (Terlapor IV);for Construction of Buildings, Schools, and Health Care for Working Unit of Nias Rehabilitation and Reconstruction of North Sumatra ProvincePejabat Pembuat Komitmen Lelang Bangunan Gedung, Sekolah dan Kesehatan Satuan kerja Rehabilitasi dan Rekonstruksi Kepulauan Nias Propinsi Sumatera Utara (Terlapor V); (the Reported Party V) and the Head of Working Unit of Rehabilitation and Reconstruction of Nias Islands of North Sumatra Province (the Reported Party VI) were not proven to have been involved in any tender conspiracies to facilitate PT Taramulia Setia Pratama Luhur (the Reported I) as being awarded the tender.
Through a series of review process undertaken by the Investigation Team KPPU RI, found some facts as follows:
- The tender object handled in this case is Construction of Buildings, Schools, and Health Care for Working Unit of Nias Rehabilitation and Reconstruction of Nias Islands for Fiscal Year 2009, with a maximum value of 8 (eight) billion Rupiah from the State Budget for Fiscal Year 2009.
- In the examination process, it was revealed that PT Setia Pratama Taramulia Luhur (the Reported Party I), PT. Untario Metalindo (Terlapor II), PT. Untario Metalindo (the Reported Party II), and PT. Eka Perkasa Indah (Terlapor III) dengan difasilitasi oleh Panitia bekerjasama untuk mengatur dan atau memenangkan PT Taramulia Setia Pratama Luhur sebagai pemenang lelang berdasarkan fakta antara lain: Eka Perkasa Indah (the Reported Party III) were facilitated by the Committee to collaborate in regulating and/or giving PT. Taramulia Setia Pratama Luhur the tender award based on the facts which, among others, were:
a. The equality of documents among PT. Taramulia Setia Pratama Luhur (the Reported Party I), PT.Untario Metalindo (Terlapor II), PT. Untario Metalindo (the Reported Party II), and PT.Eka Perkasa Indah (Terlapor III); Eka Perkasa Indah (the Reported Party III);
b. The presence of cross ownerships (cross management) among PT. Taramulia Setia Pratama Luhur (the Reported Party I), PT. Untario Metalindo (Terlapor II), PT. Eka Perkasa Indah (Terlapor III) dan kesamaan data personil diantara ketiganya; Untario Metalindo (the Reported Party II), and PT. Eka Perkasa Indah (the Reported Party III) and the equal personnel data among the three companies;
c. The serial number, registered number and bond number in offered warranty documents owned by PT Taramulia Setia Pratama Luhur (the Reported Party I) and PT.Untario Metalindo (Terlapor II) berurutan; Untario Metalindo (the Reported Party II) were sequential;
d. The serial number and letter number listed in Notice Letter for Financial Support from Bank Sumut (a private bank in North Sumatra) owned by PT. Setia Pratama Taramulia Luhur (the Reported Party I) and PT. Untario Metalindo (the Reported Party II) were sequential;
e. The same addresses used by PT. Taramulia Setia Pratama Luhur (the Reported Party I), PT.Untario Metalindo (Terlapor II), PT. Untario Metalindo (the Reported Party II), and PT.Eka Perkasa Indah (Terlapor III) yang dicantumkan pada saat mengisi formulir permohonan surat keterangan dukungan dana dari Bank Sumut yaitu di Jl. Eka Perkasa Indah (the Reported Party III) put down at the time of filling in the application form of the Notice Letter for Financial Support from the Bank Sumut was Jl.Sudirman No. Sudirman No.16A, Gunung Sitoli – Nias; 16a, Gunung Sitoli – Nias District;
- The Evaluations of the Commission Assembly on the above facts, among others, are:
a. The Commission Assembly assessed that the equal documents, errors in writing and equal corporate management showed indicative cooperation between the Reported Party I, the Reported Party II and the Reported Party III in preparing tender documents;
b. The Commission Assembly assessed that there were sequential serial numbers and letter numbers listed in the Notice Letter for Financial Support from Bank Sumut (a private bank in North Sumatra) owned by PT Setia Pratama Taramulia Luhur (the Reported Party I) and PT. Untario Metalindo (the Reported Party II), equal writings in the Request Form for Financial Support proposed by the Reported Party I and Reported Party II, and equal addresses indicating that the request letter was handled by the same person;
c. The Committee’s action that ignored the equal administrative documents belonging to the Reported Party I, the Reported Party II and the Reported Party III was an action meant to facilitate the Reported Party I as the tender receiver.
Majelis Komisi merekomendasikan kepada Komisi untuk memerintahkan kepada atasan langsung Panitia untuk memberikan sanksi administratif kepada Panitia lelang karena telah melanggar Pasal 22 Undang-undang Nomor 5 Tahun 1999.The Commission Assembly recommended the Commission to order the Committee’s direct superior official to give the tender committee an administrative sanction for having violated Article 22 of Law No.5 Year 1999.
That, based on the facts and overall judgments above, and bearing in mind Article 43 paragraph (3) of Law No.5 Year 1999, the Commission Assembly decided to:
- State that the Reported Party I, the Reported Party II, the Reported Party III, and the Reported Party IV were proven legally and convincingly to have violated Article 22 of Law No.5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition;
- State that the Reported Party V and Reported Party VI were not proven to have violated Article 22 of Law No.5 Year 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition;
- Penalize the Reported Party I to pay a penalty of Rp.200.000.000,- (dua ratus juta rupiah) yang harus disetor ke Kas Negara sebagai setoran pendapatan denda pelanggaran di bidang persaingan usaha Satuan Kerja Komisi Pengawas Persaingan Usaha melalui bank Pemerintah dengan kode penerimaan 423755 (Pendapatan Denda Pelanggaran di Bidang Persaingan Usaha);200.000.000,- (two hundred million rupiah) that shall be paid to the State Treasury Office (Kas Negara) as a penalty revenue for violation in business competition for the Working Unit of The Commission through a state-owned bank with an acceptance code 423 755 (Penalty Revenue for Violation against Business Competition / Pendapatan Denda Pelanggaran di Bidang Persaingan Usaha);
- Prohibit the Reported Party II and the Reported Party III to get involved in any tender in North Sumatra Province for 1 (one) year since this decision has a fixed legal effect.
The investigation and preparation of a decision on case No.29/KPPU-I/2009 dilakukan oleh KPPU dengan prinsip independensi, yaitu tidak memihak siapapun karena peran KPPU sebagai pengemban amanat pengawasan terhadap pelaksanaan UU No. 30/KPPU-I/2009 were conducted by the KPPU with an independent principle that was impartial towards all parties because of the KPPU’s role as a mandate holder for supervising the implementation of Law No.5/1999 yang berusaha mewujudkan kepastian berusaha yang sama bagi setiap pelaku usaha dan menjamin persaingan usaha yang sehat dan efektif. 5/1999 that manages to realize the equal business certainty for every business actor and to ensure a fair and effective competition.Putusan tersebut dibacakan dalam Sidang Majelis Komisi yang dinyatakan terbuka untuk umum pada hari Rabu, tanggal 2 Juni 2010 di Ruang Pemeriksaan III, Gedung KPPU Lt.1, Jl.
