WORKSHOP ON CARTEL MARKET DEFINITION

“Market Definition is a basic tool in Competition Law” stressed Nick Taylor, an expert from the the Organization for Economic Cooperation and Development/Korea Policy Centre during the Workshop on Cartel and Market Definition held in Bogor on 24-26 Macr 2010. The workshop which one form of cooperation between the KPPU and OECD-Korea Policy Centre, Competition Programme acknowledge as a rare and yet valuable opportunity for experiencing and implementing competition issues related to the Law No 5/1999 and international best practices.

The workshop discussed two important and challenging topics, namely relevant market analysis involving advance phenomenon such two-sided market. Without being noticed in our daily routine, this phenomenon is implemented and might be part of our life. Some examples in this market such retail distribution; video games, paid television, and credit/debit card are gracious to all of us. How far the two-sided market is take role in anti-trust law, is one of the main themes of this workshop.

Apart from relevant market and two-sided market, the use of economic analysis in competition law for cartel cases also being discussed. For country with relatively at the early step in implementing competition law, the use of heavy economic analysis in cartel cases is trully create its own challenge, especialy when facing the availability of data, analysis, and ways to convince judges on the validity and accuracy for arguments within the commission’s decission.The success in implementing economic evidence in decision will very much depend on mentioned conditions.

It is rest assure that the ability of KPPU’s officials will significant in increasing the commission’s capacity in using economic evidences for cartel cases, as implemented by other international and developed competition agency. For our colleagues from the ministries who attending, this workshop will provide valuable experience for sharing of information that could be use in formulating best policies that could prevent the creation of anti-competitive practices.

The workshop also provide opportunity for participants having discussion and share experiences with the prominent competition experts attending the workshop, namely Mr Nick TAYLOR (OECD-Korea Policy Centre), Mr Jaeho MOON, Korea Fair Trade Commission (Korea Fair Trade Commission), Mr Peter VAN DE HOEK, (Australian Competition & Consumer Commission), Mr Gianluca SEPE (Italian Competition Authority), and Mr Kentaro HIRAYAMA (Japan Fair Trade Commission). Those are international experts in competition law and policy with indubitable competency. Therefore, it is expected any experiences and knowledge gained by the participants in the event will surely take part in the development of their capacity as well as the development of the Commission and competition policy and law as whole.
