On Wednesday, 19 September 2018 the Commission Council consisting of Dr. M. Afif Hasbullah, S.H., M..Hum., Kurnia Toha, S.H., LL.M., Ph.D., and Kodrat Wibowo, S.E., Ph.D decided that Reported Party I (PC Muriah Ltd.), Reported Party II (PC Ketapang II Ltd.), and Reported Party III (PT Aquamarine Divindo Inspection) were proven to be legally and convincingly violated Article 22 of Law Number 5 of 1999 on Bid Provision of Under Water Services for Kepodang and Ketapang Field (Tender No. 11204) with owner’s estimate (OE) total value of Rp. 47,360,900,000.00 (forty seven billion three hundred and sixty million nine hundred thousand rupiah).

Reported Party I (PC Muriah Ltd.,) and Reported Party II (PC Ketapang II Ltd.,) extended a special treatment to Reported Party III (PT Aquamarine Divindo Inspection) by deciding Reported Party III as the bid winner even though Reported Party III did not satisfy the requirements. The Commission Council was also of the view that there was an indication leading the requirements to specific bid participants that was part of the attempts made by Reported Parties I and II in facilitating Reported Party III to become the bid winner in the case at hand. Therefore, the element of collusion was met.

The Commission Council decided to impose fines to Reported Party I with the amount of Rp1,243,000,000.00 (One billion two hundred and forty-three million rupiah), Reported Party II with the amount of Rp1,243,000,000.00 (One billion two hundred and forty-three million rupiah). In addition, the Commission Council also ordered Reported Parties I and II to cancel the Bid Provision of Underwater Services for Kepodang and Ketapang Field (Tender No. 11204).
