ICC CALLS LION AIR TO FULFILL ICC’S SUMMONS AS A WITNESS IN THE CASE OF THE SELECTION OF UMRAH TICKET SALES PARTNERS.

Lion Mentari Airlines (Lion Air) did not fulfill the summons of the Indonesia Competition Commission (ICC) as a witness in the Continued Examination Hearing of Case No. 06/KPPU-L/2020 regarding Alleged Practice of Discrimination of PT Garuda Indonesia (Persero) Tbk in respect of the Selection of the Umrah Ticket Sales Partners to and from Jeddah and Madinah (or popularly known as the Umrah Ticket Case) which was held today at ICC. This was the first summons addressed by ICC to Lion Air for the relevant case.

Lion Air in the said case constitutes one of the witnesses put forward by the Commission Council side in order to especially strengthen the instrument of proof of the practice of discrimination committed by PT Garuda Indonesia (Persero) Tbk in selecting the Umrah ticket sales partners. Regarding the summons for the ICC hearing, Lion Air did not give any confirmation of attendance whatsoever with regard to the summons for ICC hearing. Business actors are prohibited from rejecting to be examined, rejecting to provide information required in the pre-investigation and or examination, or obstructing the pre-investigation and or examination proceedings based on the provisions as intended in Article 41 paragraph (2) of Law No. 5 Year 1999 regarding Prohibition of Monopolistic Practices and Unfair Business Competition (Law 5/ 1999). If the provisions of the article are infringed, ICC may hand over such infringement to investigators to be investigated in accordance with the applicable provisions.

For this reason, ICC calls upon Lion Air to take a cooperative attitude in fulfilling every summons to be given by ICC for the ongoing examination proceedings.
